As you may be aware, a by-election is mandated by democratic processes, serving as a necessary procedure following the resignation of a councillor. Upon such an event, the electorate is duly notified by the district council.
Should the electorate express their desire to proceed with a by-election poll, wherein a formal vote is conducted, they are required to register with the district council accordingly. Subsequently, if the request is validated by the district council a legal election is called, the district council informs the town council of the necessity to hold the election, including the designation of the polling date.
It is imperative to note that the town council is bound to comply with these legal obligations without discretion. In instances where residents do not come forward to call for a poll, the town council may, proceed with the process of advertising for co-option. However, it remains clear that this decision is not one made at the discretion of the town council.
